Rules for using the store and purchasing products

These Terms are issued by and apply to HK Falcon Overseas Limited, located at Unit 903, 9/F., Cameron Comm Centre, 458-468 Hennessy Road, Causeway Bay, Hong Kong. References to "we," "us," "our," or the "Company" in these Terms mean HK Falcon Overseas Limited.

1. Agreement to These Terms
These Terms of Service ("Terms") govern your use of drawlark.store and any purchase you make from https://drawlark.store (doing business as MistlyAU, "we," "us," or "our"). By using the store or placing an order, you agree to these Terms and to the policies referenced in them. If you do not agree, do not use the store.

Nothing in these Terms excludes or limits a consumer right that cannot lawfully be excluded or limited.

2. Age Restriction and Legal Compliance
Vaping products are age-restricted. You may purchase from this store only if you are at least the minimum legal age for purchasing vaping products in the place where you are located, and in no case younger than 18.

By placing an order, you confirm that you meet that requirement, and that the purchase, importation, and possession of the products you order are lawful where you are located. You are responsible for checking and complying with the laws that apply to you.

We may ask for age or identity verification at any time. We may cancel and refund an order if verification is not provided, or if we reasonably believe that fulfilling the order would breach applicable law. We do not sell to minors.

3. Product Categories and Product Information
MistlyAU, operated by HK Falcon Overseas Limited, is an online retailer of vaping products at https://drawlark.store. Our product categories include:

· Disposable vaping devices, being single-use devices commonly described by their rated puff count.
· Rechargeable pod devices and replacement pods.
· E-liquids and related consumables.
· Accessories, including charging cables and replacement parts.

The available product range may change over time. The products offered for purchase, their nicotine strength, flavour, battery and charging specifications, and included items are described on the relevant product pages. A category description does not mean that every product or accessory within that category is available.

Vaping products contain nicotine unless expressly stated otherwise. Nicotine is an addictive chemical. Products should be used only for their stated purpose and in accordance with the instructions and safety information provided. Sales are subject to these Terms, our Shipping & Delivery Policy, and our Refund & Return Policy. Nothing in this section limits any mandatory consumer right under applicable law.

We aim to describe products accurately. Colours and appearance may vary because of photography, displays, production tolerances, and materials. Puff counts, battery capacity, nicotine strength, and other specifications are approximate or as stated by the manufacturer unless expressly stated otherwise. Product images are illustrative and packaging may change.

4. Product Safety
· Do not use a device that is damaged, leaking, overheating, or giving off an unusual odour, and do not use a device with a damaged cable, connector, or battery.
· Charge only with a compatible charger and follow the manufacturer's instructions. Do not leave a device charging unattended or in a hot environment.
· Do not modify, disassemble, or refill devices that are not intended to be refilled.
· Keep all devices and e-liquids out of the reach of children and pets.
· Do not drink or ingest e-liquid. If e-liquid is swallowed, or comes into contact with your skin or eyes, follow the label instructions and seek medical advice promptly.
· Vaping products are intended for adult smokers and vapers. They are not medicines, are not a therapeutic product, and are not presented as a smoking-cessation treatment.

5. Prices, Taxes, and Charges
Prices are shown in the currency displayed at checkout and may change before an order is placed. Applicable taxes, shipping charges, duties, and other fees will be displayed or described before purchase where required. You are responsible for import duties and taxes unless checkout states that they are included.

6. Orders and Acceptance
An order confirmation acknowledges that we received your order; it does not necessarily mean the order has been accepted. We may reject or cancel an order for legitimate reasons, including suspected fraud, payment failure, pricing or inventory errors, shipping restrictions, age-verification failure, an order that appears intended for unauthorised resale, or an order that would breach applicable law.

If we cancel after payment, we will refund the amount paid to the original payment method. We may limit quantities on a reasonable and non-discriminatory basis.

7. Payment
You authorise us and our payment providers to charge the amount shown at checkout. Payment services may be subject to additional provider terms. We do not guarantee that every payment method will be available in every location.

8. Shipping and Delivery
Shipping, delivery estimates, address requirements, duties, and risk-of-loss rules are described in our Shipping & Delivery Policy. Delivery dates are estimates unless expressly guaranteed. If a delay gives you a cancellation or refund right under applicable law, that right will be honoured.

9. Returns, Refunds, and Cancellations
Our Refund & Return Policy explains eligibility, time limits, exclusions, return shipping, damaged or incorrect items, and refund timing. Mandatory consumer rights in your location remain unaffected.

10. Promotions and Discount Codes
Promotions are subject to their stated terms, availability, and end dates. Unless a promotion states otherwise, discount codes cannot be combined, have no cash value, and cannot be applied retroactively. We may correct or cancel a promotion affected by error, abuse, or fraud, subject to applicable law.

11. Acceptable Use
You may not use the store to:
· Violate law, another person's rights, or these Terms.
· Submit false, misleading, fraudulent, or harmful information, including false age or identity information.
· Purchase products on behalf of, or for supply to, anyone below the minimum legal purchasing age.
· Probe, disrupt, overload, bypass, or interfere with store security or operation.
· Introduce malware, scrape the store at unreasonable scale, or use automated systems in a way that harms the service.
· Impersonate another person or misuse payment, account, or contact information.
· Copy, exploit, or commercially reuse store content except as allowed by law or with written permission.

12. Intellectual Property
The store's text, layout, graphics, and other original content are owned by us or used with permission and are protected by applicable intellectual-property laws. Product names and brand names are used descriptively to identify the goods offered and do not imply any affiliation with, or endorsement by, their owners. You may use the store only for personal, lawful shopping purposes.

13. Reviews and User Content
If you submit a review, image, or other content, you confirm that you have the right to share it and that it is accurate, lawful, and not misleading. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and format that content for store operations and promotion, subject to applicable privacy law. We may moderate or remove content for legitimate reasons.

14. Third-Party Services and Links
The store may rely on or link to third-party services, including payment, hosting, shipping, social, and analytics services. We are not responsible for third-party content or services outside our control, but this does not limit rights you may have against us under applicable law.

15. Disclaimers
To the maximum extent permitted by law, the store and its content are provided on an "as available" basis. We do not promise uninterrupted or error-free access. Product warranties are limited to warranties expressly provided with the product and any non-waivable legal guarantees. We do not exclude warranties or remedies that cannot lawfully be excluded.

16. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, exemplary, or consequential loss arising from use of the store or products. Any aggregate liability that may lawfully be limited will not exceed the amount paid for the product or order giving rise to the claim. These limitations do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.

17. Indemnity
Where permitted by law, you agree to reimburse us for reasonable losses and costs arising directly from your unlawful use of the store, infringement of another person's rights, or material breach of these Terms. This provision does not apply to ordinary consumer use or where prohibited by law.

18. Governing Law and Disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules. Nothing in these Terms limits any mandatory consumer protections that apply where you live.

Before starting formal proceedings, please contact support@drawlark.store so we can try to resolve the matter. You may also have access to a local consumer-protection authority or a legally recognised dispute-resolution service.

19. Changes and Severability
We may update these Terms for future use of the store. The version posted when an order is placed generally governs that order unless law requires otherwise. If a provision is unenforceable, the remaining provisions will continue to apply to the extent permitted.

20. Sanctions Compliance
You may not use the store if you are located in, organised under the laws of, or ordinarily resident in any country or territory subject to sanctions or embargoes imposed by applicable authorities.

You represent and warrant that you are not identified on any applicable sanctions list.

We reserve the right to suspend or refuse access to the store if we determine, in our sole discretion, that such access may violate applicable sanctions laws or regulations.
